§ 14-122. Finances, property and equipment.

  • (a)

    Town to provide. The town shall provide and own all equipment, real estate and money necessary to properly operate and maintain the fire and emergency medical services department.

    (b)

    Appropriations. The town board shall appropriate funds to provide for the operation, equipment and apparatus of the fire and emergency medical services department as the board may deem expedient and necessary to maintain efficiency and to properly protect life and property from fire and other hazards.

    (c)

    Insurance refund and contract money. Annually, all two percent insurance refund money received from the state department of safety and professional services and money the town collects from contract fees and out of township-run fees shall be put into a contingency fund for new equipment. This fund shall be used primarily to offset the costs of new apparatus.

    (d)

    Use of property and equipment. Use of all firefighting property, apparatus, equipment, and emergency medical equipment shall be limited to official use, including responding to alarms within the town fire department and emergency medical services area, response to mutual aid requests, department drills and other official tasks for the town. Water fight and parade participation approved by the fire chief shall be deemed appropriate official use.

    (e)

    Fees; lien and collection. Any person requiring the services of the EMS shall pay the fees for such services provided which, from time to time, are established by the town board by separate resolution. The town clerk-treasurer is authorized to collect such fees based on the information provided by the EMS. If, following notice as provided under Wis. Stats. § 66.0703, the cost for the EMS services remains unpaid, the town clerk-treasurer may place the amount owed on the real estate tax rolls of the town in November of each year and the levy shall be collected as a special charge pursuant to Wis. Stats. § 66.0703.
